The chairwoman of the Equal Opportunities Commission (EOC) has refused to pay management fees for her flat since March last year as she believes the management office has not fully discharged its responsibilities, the Small Claims Tribunal heard yesterday.

Anna Wu Hung-yuk was brought to the tribunal by the Incorporated Owners of Glory Mansion, Macdonnell Road, Mid-Levels, who are seeking to recover $32,175 in outstanding management fees for the period of a year up to March, when the writ was filed.

The case, however, was dismissed by adjudicator Leung Yuet-han, who said the tribunal did not have jurisdiction to handle the claim.

'It is not just about the management fee. The case involves the liabilities of flat owners and the management office,' she said. 'It also concerns different interpretations of clauses of the Deed of Mutual Covenant of the premises. The case should be dealt with by the Lands Tribunal.'

Outside the tribunal, Ms Wu said she had stopped paying management fees last year due to 'unsolved problems' that emerged in 1997, but declined to give further details.
