A minibus driver who crossed a double white line to pass a racing cyclist, only to kill another cyclist, has been told he is going to jail.
Kwun Tong Court Magistrate Stephen Smout yesterday found Shek Ming-yau guilty of dangerous driving causing death and remanded him in custody until August 17, calling for a background report to determine his jail term.
Mr Smout ruled that the driver had taken 'a deliberate risk' in overtaking another cyclist on a left-bend in Hoi Ha Road, Sai Kung, before the collision that took the life of cyclist Brendan Chiu Hsiu-hon on November 6 last year.
Chiu collided head-on with the minibus while racing downhill near the Pak Sha O Youth Hostel.
Shek faces a maximum penalty of a HK$50,000 fine, five years' imprisonment and disqualification from driving for at least two years.
'In this case, the aggravating feature was that you engaged in deliberate risk-taking when you decided to overtake,' Mr Smout said. 'The result of your taking that risk caused a man to lose his life.'
The dead cyclist's younger sister, Fiona Chiu Wai-teng, who flew from England for the hearing, wept on hearing the verdict.
