Assault over cigarette

An unemployed man was ordered to perform 120 hours of community service and fined HK$1,800 for dropping a cigarette butt in public and assaulting a food and environmental hygiene officer when arrested, Kwun Tong Court heard yesterday.

The court was told that 50-year-old Lo Sin-shun was caught dropping a cigarette butt in Shui Wo Street in Kwun Tong on January 13.

Lo had pleaded not guilty to one count each of depositing litter in a public place, obstructing an officer and common assault.

Lo said he had accidentally dropped the cigarette butt while trying to avoid being hit by a car.

He claimed he was trying to pick up the butt when arrested. He struggled with the officer but was uncertain whether he had struck him. Lo was found guilty of the three charges on June 8.

Magistrate Gary Lam Kar-yan considered positive comments in a community service report and decided on a non-custodial sentence.
