Rebel radio to stay off air until court ruling
Rebel broadcaster Citizens' Radio is staying off air this weekend despite the lifting of an injunction against it on Friday.
High Court judge Michael Hartmann did not renew an injunction against the unlicensed station on Friday, but the radio operators said they had no immediate plans to resume broadcasting.
League of Social Democrat lawmaker Leung Kwok-hung, who is involved with the station, said they would stay off air at least until tomorrow, when Mr Justice Hartmann delivers his reasons for not renewing the injunction.
But the judge will not rule on the constitutionality of the Telecommunications Ordinance or whether Mr Justice Barnabas Fung Wah was right to grant an injunction the previous week.
'After we hear what Justice Hartmann says on Monday, we will also try to assess the government's stance,' Mr Leung said. 'It's unlikely we will broadcast until all the issues have been clarified.'
Mr Justice Hartmann warned the broadcasters on Friday that despite the absence of an injunction against them, unlicensed broadcasting would leave them open to legal action since the Telecommunications Ordinance remained in effect.
The Department of Justice has initiated contempt of court proceedings against six activists for their breach of the injunction on January 10 but Mr Leung said he had yet to receive the court summons.
