Waste dumping: man in court

The only person charged so far over the dumping of construction waste on farmland at a Sheung Shui village has appeared in court.

Man Chun-shing, director of the Treasure Palace Property Agency, entered no plea in Sha Tin Court yesterday to breaching the Town Planning Ordinance by filling land at Ho Sheung Heung, in Kwu Tung, some time between June 18 and July 17.

According to the summons, the land is within what the Planning Department calls a development permission area and part of the Kwu Tung North outline zoning plan.

A department representative said it needed more time to consider whether to merge the case with a related one from another department. Magistrate Li Wai-chi adjourned the case to November 11 to meet the department's request.

Section 20 of the ordinance makes it unlawful to develop land included in a Town Planning Board draft plan.

Anyone who contravenes it faces a maximum fine of HK$500,000 on first conviction and HK$1 million on any subsequent conviction.
