The Court of Appeal ruled yesterday that an indigenous villager does not qualify as a 'lawful successor' to land owned by his father if the land is given to him while the father is alive. Lai Hay-on, of Po Sum Pai Village in Tai Po, lost his appeal against a Lands Tribunal decision in 2007 that he had no right to a waiver of government rent on a piece of land his father had given him, since Lai had not inherited the land on his father's death.
