Ex-buildings chief in court over toilet leaking into neighbour's flat
Former Buildings Department chief Choi Yu-leuk appeared in Kowloon City Court yesterday charged with failing to comply with an order to stop water seeping from his flat into the one below.
The seepage, which allegedly came from Choi's toilet, had been bothering the family living below for years, according to reports in Chinese-language media.
As the owner of the flat, in a building on Prince Edward Road West, Kowloon, Choi was charged for failing to comply with the requirements of a nuisance notice issued by the Food and Environmental Hygiene Department on March 5, which ordered him to repair the floor slab and walls of his toilet to prevent seepage to the flat below, according to the summons.
He had failed to provide water-proofing material for the toilet to prevent recurrence of the nuisance.
Choi did not enter a plea. The hearing was adjourned to July 13 for the prosecution to seek legal advice from the Department of Justice on questions raised yesterday by the defence.
The prosecution withdrew charges against Choi King-chow and Chow king-lun, co-owners of the flat, because they are currently living and working overseas.
The former Buildings Department head could face a fine up to HK$10,000 and a daily fine of HK$200 if convicted.
