Three sentenced for rape of girl, 13

A 20-year-old man who, with three other men, raped a drunken 13-year-old girl after playing cards at his home was jailed for six years. Two younger rapists were sent to a training centre.

Yip Man-chun, 20, a casual worker, was convicted in the Court of First Instance of rape for his assault on the victim at his Tin Shui Wai home in October last year.

The girl waited for two months before she reported the incident to police because she was afraid of her family's possible reaction, the court heard. Madam Justice Maggie Poon Man-kay said the case was serious because it involved a young victim and more than one offender. The case was aggravated by the fact that the girl was drunk and powerless to resist during the incident.

Poon criticised Yip Man-chun for denying the charge. That had resulted in the girl having to relive the ordeal again while giving evidence during a trial, an experience which had been stressful for her.

The judge said Yip Man-chun had failed to show understanding of his actions or remorse during the trial.

Yip's brother, Yip Man-sum, 18, and Ko Tik-man, 17, who pleaded guilty to rape, were sentenced to unspecified terms at a training centre.

The judge said she had sent them to a training centre because of their young age, their early pleas and the likelihood that they would benefit from such training.

The court earlier heard that the victim had met a man nicknamed 'Tin Gai' and later met Yip Man-chun. She was invited to visit Yip's home. She played cards and games with four men and consumed five to six glasses of beer, the court heard.

Later she told police that she was raped by four men that night but could not resist because she was so drunk.

The fourth man, 'Tin Gai', has not been identified.
