Reproductive technology: the basics

Can unmarried people have reproductive technology (RT) procedures?

No. It is prohibited under the Human Reproductive Technology Ordinance.

Can I choose the sex of my child?

Sex selection by means of a RT procedure for any reason other than the avoidance of a sex-linked genetic disease is prohibited.

I am using a donor's gametes or embryos in my treatment. Who will be the legal parents of the baby?

If a woman is given a donor's gametes or embryos, she is regarded as the mother and her husband the father - unless it is shown he did not consent to the treatment.

Is surrogacy allowed in Hong Kong?

Commercial surrogacy is illegal.

Is there any age limit for making donations?

In general, female donors should be under 35 and male donors under 55. These age limits may be exceeded in some circumstances. Also, gametes should not be taken from anyone under the age of 18.
