A fire officer, whose sister is an acclaimed martial arts master, wept yesterday as she was cleared of perverting the course of public justice.
Senior Station Officer Lee Ship, 39, was acquitted after deputy magistrate Colin Wong Sze-cheung in Eastern Court ruled that her failure to report an obstruction in a cafe was a misjudgment, not a crime.
Lee claimed outside court that she had been set up.
The court heard she had not reported a table obstructing a fire exit in a cafe she had inspected.
Her supporters, who filled the court's public gallery, clapped and cheered as Wong handed down his judgment.
Lee took a deep breath before breaking down into tears.
"The magistrate has made a fair judgment today," she said outside court. "My colleagues have used the system to set up their colleagues, and this is really scary."
The court ruled that Assistant Divisional Officer Ng Wai-shing, who testified against her, was not an honest witness. Wong said Ng had pursued the case in an unusually proactive manner and placed undue emphasis on his efforts to gather evidence fairly.
The court heard earlier that Lee had failed to report a "floating obstruction" - a table - standing in the way of a fire exit when she was investigating a complaint at Le Grand Café, Causeway Bay, on March 31 last year. She also did not record it in a memo to the fire department on April 2.
Wong accepted Lee's defence that she did not realise there was a fire exit where the table stood, nor did she think it could be an obstruction.
He said video footage presented to court showed no sign of Lee looking in the direction where an emergency exit sign was hung.
The fact that she did not measure the table, Wong added, showed she did not see it as a barrier.
The court previously heard the staff had said they would remove the table after finishing their meal there.
"There was no evidence that Lee [initially] decided to prosecute but then decided not to," Wong concluded.
Lee said she was disappointed about the incident and would contemplate her future at the department.
He sister, Li Fai, is a multiple award-winning martial artist, whose titles include a silver medal at the Asian Games in 2002.
Li also runs martial arts teaching centres in North Point and Tsuen Wan.
