Hong Kong minibus driver, 71, jailed for incest with mentally-retarded daughter, 18

A 71-year-old minibus driver was sentenced to 10 years in prison for committing incest with his mentally disabled teenage daughter, causing her to contract a sexually transmitted disease.

A 71-year-old minibus driver was sentenced yesterday to 10 years in prison for committing incest with his mentally disabled teenage daughter, causing her to contract a sexually transmitted disease.

High Court judge Mr Justice Patrick Li Hon-leung said it was an outrage against human decency for S, whose real name was not disclosed in court for the girl's protection, to have claimed the victim must tolerate the sexual attacks because he paid her medical expenses.

S had earlier pleaded not guilty to two counts of incest.

Li said the offences may not have come to light if S and the 18-year-old victim had not both contracted trichomoniasis, a sexually transmitted infection.

He said the case involved a serious breach of trust, and the attacks had an impact on the victim both physically and psychologically.

Previously, the court heard that the girl moved to Hong Kong from the mainland in 2012, and S rented a subdivided flat for her, visiting her from time to time.

The prosecution said S sexually assaulted his daughter, who had an IQ of 65, in May and July 2013. At the time, the victim was 16 but had a mental age of five.

The court heard the victim attempted to resist S's advances, but succumbed to him after thinking her brother might be left living alone if S was arrested. The girl said S gave her gifts every time after he assaulted her.

In a video interview broadcast during the trial, the victim said her father had reminded her not to tell anyone about the attacks, or her life would be very miserable.

The victim did not disclose the attacks to anyone because she wanted to protect her father.

The case was reported to police after the girl consulted doctors in September 2013 after feeling unwell.

Yesterday, even though he was represented by lawyers, S submitted his own arguments in mitigation.

"I have been taking good care of her all along with my friends," S said.

He again denied that he had sexually assaulted his daughter.
