PROPERTY consultants believe they can be jailed due to government incompetence if the recently gazetted Estate Agents' Bill becomes law.
Property agents can face criminal prosecution, possibly fines and prison if they fail to provide the facts on a property they are marketing.
Estate agents claim the Government's proposals are harsh and unfair. They say it is often difficult to obtain immediately all the information required when a property is put on the market.
Ironically, estate agents say the Government is one of the main obstacles to obtaining accurate information. Much of the data required comes from the Government.
The estate agents claim that information is often unclear and potentially misleading which means the Government is creating a scenario whereby estate agents can be prosecuted for presenting inaccurate details on a property which the Government itself has provided.
Charles Wheatman, director of property consultants Jones Lang Wootton, said information provided by the Government's Land Registry on crown leases was often illegible.
