A CHAUFFEUR given a four-month jail term for causing two deaths in a road accident had his conviction and sentence quashed by the High Court yesterday.
Mr Justice Duffy told the court Chan Kin-kwok's overtaking manoeuvre did not amount to reckless driving.
'The accident was most tragic and unfortunate. Under no circumstances was it a reckless driving manoeuvre,' he said.
The Crown said Mr Chan, 47, drove a BMW on a wet and slippery road and overtook a vehicle in a reckless manner, causing the accident.
It was alleged that on January 28 this year, Mr Chan was driving at about 50 km/h along Nam Fung Road near Wong Chuk Hang Path, Hong Kong Island.
He overtook, swerved into another lane and bumped into a taxi which then collided with a tourist coach, the court heard.
