A MAN who stabbed his elder brother after an argument over using the telephone was put on 18 months' probation yesterday.
Lo Kin-nang, 29, who pleaded guilty to wounding with intent, was put on probation after Judge Bailey accepted it was a 'very exceptional' case.
The brothers had a 'turbulent relationship' since childhood, the District Court heard.
Psychiatric reports by Dr Benjamin Lai said that Lo, a factory worker, had been provoked by his elder brother Lo Kin-chuen, 32, at the time of the offence. 'Dr Lai also considers he acted under the influence of marked emotional tension and long-standing psychological conflicts stemming from his unhappy childhood experiences, particularly those involving his elder brother,' Judge Bailey said.
When he made the order, the judge required Lo to receive psychological treatment as directed by the probation officer.
Judge Bailey said he had no doubt that Lo had acted on impulse and out of character. The court was told the brothers were deserted by their mother at childhood and they had always been on bad terms.
