It is understood Mr Godfrey's blood test result showed an alcohol level of 95 milligrams per 100 millilitres of blood. The lawful limit is 80 milligrams.

While the alcohol limit for the breath test is 35 micrograms per 100 millilitres of breath, Mr Godfrey had 48 micrograms - a level equivalent to about four glasses of beer.

Mr Godfrey was arrested on December 28 after a breath test in Happy Valley. He was bailed and is due to report to police today.

A prosecution against Mr Godfrey would be the first under the new ordinance on drink-driving introduced a month ago.
