A CORONER took the 'very rare' step yesterday of asking a jury to decide whether anyone should be charged over the death of a Vietnamese man who was stabbed at the High Island detention centre.

After the two-day hearing, the jury returned a verdict of unlawful killing in the case of Le Huy Cuong, 33.

But the jurors could not identify any person who should be charged with murder, they told Coroner John Saunders.

'One of the matters you must ascertain if you are able to reach a finding is to the person who is responsible . . . you are not to determine whether he is guilty or not but merely whether he should be charged,' Mr Saunders told the three-member panel.

The Coroner said he would refer the case to the Attorney-General to consider whether anyone should be charged.

After the hearing, Coroner's officer Paul Madigan, said Mr Saunders had taken a very unusual step.

Le died of a massive stab wound to the right side of his chest during a fight with another inmate in the north camp of the detention centre in Sai Kung, the court heard.
