A daughter cleared more than $40 million out of her mother's bank accounts after a severe stroke had rendered the elderly woman incapable of looking after her affairs, a High Court writ said yesterday.
Legal action has been taken on behalf of the widow, Ng Man-pui, 81, to recover the cash.
Her daughter, Ng Ching-ying, who is accused of removing the money over six years, died in 1996.
The case, brought on the mother's behalf by HSBC Trustee (Hong Kong) Ltd, is brought against the daughter's personal representative. It also targets the widow's grandson, Fong Ka-yeung, a doctor who is said to have profited from his mother's acts.
The older Ms Ng has suffered from mental disability following a stroke in October 1988. She was unable to understand documents relating to her finances and was incapable of managing her affairs, says the writ.
Her daughter would have been aware of her condition and so would Dr Fong, who had taken on the responsibility of treating his grandmother, it says.
