FORMER District Court judge Duncan Kilgour has retired after being rebuked by the Chief Justice over an incident of alleged misconduct and because he feared his judiciary career had stalled, legal sources have revealed.

The former judge, who left the bench last month and is now living in France, had been 'unhappy and frustrated' because his hopes of being promoted to the High Court had been dashed, said a lawyer and a friend of the judge.

'He realised he might not be getting promoted to the High Court and decided it was the right time for a move,' the lawyer told the Sunday Morning Post.

The Judiciary's internal inquiry began after Mr Kilgour, 55, filed a formal complaint against police following a run-in with four officers in the early hours of April 13 last year.

Mr Kilgour and his wife, Prudence, 44, had been involved in a dispute after being stopped at a roadblock on the Peak. Neither was charged.

The former judge allegedly abused his position by showing his warrant card and refusing to co-operate with police.
