Elderly woman can evict son

An elderly mother of five yesterday succeeded in evicting the son she claims once threatened to kill her.

Deputy Judge Andrew Chung On-tak ordered that Ng Hiu, 84, be allowed to take back her flat in Chun Man Court, Ho Man Tin, in which her third son, Wilson Kan Kam-chiu, 50, and his wife, Cheng Choi-chun, had been living.

Barrister Joseph Vaughan had previously told the court that Ms Ng was forced out of her flat about five years ago and now lived in a home for the aged.

The Court of First Instance judge ruled the flat, registered in Ms Ng's name, belonged to her, and that he believed her to be a reliable and truthful witness. He rejected the evidence given by her son.

Deputy Judge Chung said he had reservations over whether Ms Ng had been mistreated by her family as she had testified. He ordered the couple to pay $100 to Ms Ng.

Ms Ng claimed her son once threatened to suffocate her with a pillow when she wanted to sell the flat and that the couple's domestic helper had beaten her.
