Deaf and dumb II set free by judge

A deaf and dumb illegal immigrant accused of robbing a group of hikers was freed yesterday, because he was unable to understand the court proceedings.

Judge Peter Longley ordered an absolute discharge for the unidentified mainlander, who is believed to be aged 30. He was carrying no identification when he was arrested.

The judge ruled the defendant was unfit to plead due to his disabilities.

Although the judge said he was satisfied the man was one of the three robbers, he did not believe the defendant was able to comprehend the trial so as to make a proper defence or instruct his legal adviser.

The defendant was accused of robbery and illegally remaining in the SAR, charges to which he made no response to when they were put to him.

His barrister, David Tolliday-Wright, argued the defendant was unable to understand the charges. He applied to stop the proceedings.
