PHOENIX Laser Systems has won the second round of its legal action against Sun Hung Kai & Co director Chan Sun-sun.
The Supreme Court has lifted a stay order against the high technology company's Hongkong law suit which alleges Mr Chan misappropriated $10.4 million earmarked for a Fujian laser-crystal joint venture.
Master Jones lifted the order in chambers late last week and stayed an action launched by Mr Chan and his wife in March seeking an order that Mr Chan's use of funds in Phoenix has been done with proper authority.
A wider ranging action by Phoenix against Mr Chan in a San Francisco court is continuing, but Phoenix has dropped those parts of it dealing with conversion.
The Supreme Court earlier cited the parallel claims in staying the Phoenix order.
