'German' boy can fight for passport

A judge has given a 14-year-old boy the go-ahead to fight for his SAR passport, which was cancelled after he obtained German nationality.

Patrick Tse Yiu-hon, born in Wedel, Germany, had his passport cancelled by the Immigration Department on the grounds that he was not a Chinese citizen. The passport, issued on August 6, 1998, was cancelled on April 16 last year.

The Director of Immigration said Yiu-hon had lost his Chinese nationality after he became a German national in December 1990.

But the teenager, whose parents are ethnic Chinese born in Hong Kong, holds a valid Hong Kong permanent identity card and a British Dependent Territories Citizens' passport. His parents are SAR passport holders, the Court of First Instance heard.

Mr Justice Wally Yeung Chun-kuen yesterday granted leave for a judicial review of the decision made by the Director of Immigration and the Immigration Department's appeal board.

The judge said the case involved important issues that needed to be examined. A hearing date will be fixed later.
