Working pensioner entitled to exemption

I am a 56-year-old retired civil servant currently receiving a monthly pension of $20,000. I also work part-time as a teacher and real estate agent.

Under Mandatory Provident Fund (MPF) legislation, I have dual status.

My pension income does not have to be included in the mandatory contribution to an MPF scheme, but five per cent of my income earned as a self-employed teacher and agent has to go into the scheme.

I have written three letters to the MPF Authority requesting exemption status, but in vain. The MPF Guidebook, paragraph 1.1, 'Exempt persons' No. 4, stipulates that, 'Exempt persons refer to people covered by statutory pension and provident fund schemes, such as civil servants and subsidised or grant school teachers.'

My argument is as follows:

Currently, I am already covered by a statutory pension scheme, which means that I am being provided with sufficient income for my retirement years.
