A SNAKE skin tanner who fractured his ankle when hit by a car was yesterday awarded $1.5 million in damages for personal injuries. Mr Justice Ryan, giving judgment in favour of Chu Yiu-chuen, 26, held that the accident was solely caused by the negligence of driver Lau Chau-sang. The High Court heard that Mr Chu, who was represented by K. B. Ng, was changing a tyre on his brother's taxi at about 3 am on October 22, 1987, in Hart Avenue, Tsim Sha Tsui. He was standing by one of the back wheels when the car driven by Mr Lau went over his left ankle. He lost consciousness and was taken to hospital, where he underwent an operation. According to his brother, Chu Yiu-fung, who was with him at the time, the car did not stop but continued to the junction with Carnarvon Road, where it struck the back of a taxi that had stopped at a traffic light. Awarding Mr Chu damages totalling $1,569,594 plus interest, Mr Justice Ryan said he did not consider the plaintiff contributed in any way to the accident. Mr Lau's claim that Mr Chu ran out from behind parked cars was without foundation, the judge said.
