Three policemen, who were jailed for fabricating allegations against a disco manager to cover up the fact that he had been assaulted by one of them, yesterday failed to have their convictions overturned. The Court of Appeal dismissed the appeal by former senior inspector Lee Chi-fai, 40, and sergeants Wong Yu-lun, 45, and Au Yeung Yu, 51, and said they were all convicted on the basis of overwhelming evidence in the high-profile case. In February last year, District Court Deputy Judge Anthony Kwok Kai-on convicted Lee for perverting the course of justice and common assault and jailed him for 2 ? years. Lee had denied both charges. Wong and Au Yeung were each jailed for 18 months for perverting the course of justice. They were acquitted of aiding and abetting common assault. Both men had denied all charges. The court had heard that the three officers, attached to the Yuen Long anti-triad squad at the time of the offence, went to the Catwalk Fantasies disco on January 12, 2001, where they asked to see the manager, Tai Hiu-tung. Mr Tai, 32, said he was ordered to follow the three officers to a lane behind the disco, where Wong asked the whereabouts of an ex-employee. Mr Tai said Lee punched and kicked him when he failed to give a satisfactory answer. The court was told the officers filed false statements regarding the evening's events and Mr Tai was charged with obstructing them from carrying out their duties. The charge was dropped in February 2001 after Mr Tai lodged a complaint, supported by a security video of the incident, with the Complaints Against Police Office on January 17. Defence barristers Andrew Macrae SC and Cheng Huan have argued that the trial judge should not have relied on the videotape recording at all. They said the videotape was not authentic as material parts of it had been altered in a way which produced what they claimed to be a false picture of the incident. However, Mr Justice Michael Stuart-Moore, Mr Justice Frank Stock and Mr Justice Pang Kin-kee found no merit in any of the grounds raised.
