Nightspot loses appeal against noise ban

The nightlife around popular Knutsford Terrace bar Chasers will be quieter these days after the nightspot lost a court challenge against a noise ban.

The Court of First Instance heard the Noise Control Authority issued a notice on April 2 last year ordering the bar to maintain an inaudible level of noise from 11pm to 7am.

The authority became involved after residents of Carlton Building, which houses Chasers, complained to the Environmental Protection Department.

After losing an appeal against the notice, Step In Ltd, the firm managing Chasers, filed a judicial review asking the Court of First Instance to decide on the legality of criteria used to assess noise levels.

It also argued that the noise limit was out of the control of Chasers.

Yesterday, Madam Justice Carlye Chu said that in upholding the ban she had considered the evidence of several academics in assessing the use of inaudibility as a criterion for assessing noise levels.
