BOC files writ against three to recoup US$42m

THE Bank of China has filed a Supreme Court writ that sues three people for the return of US$42 million which it claims has been transferred out of an account using forged instructions.

Named as defendants are Sun Ming, of a California address; and Guo Jiang Ling, alias Guo Jian Ling, and Ren Peng, both of Australia.

The plaintiff's claim, according to the endorsement in the writ, is for damages for conspiracy to defraud, or for the tracing and recovery of more than US$42 million remitted from the account of China Huitong (Group) Corporation, allegedly by forged instruments or transfer.

The bank is also seeking an injunction stopping the defendants withdrawing, transferring, encumbering, disposing of or otherwise dealing with proceeds of the remittance in any bank account in Hong Kong.

No further details were given in the writ.
