Alex Ho Wai-to, the Democratic Party candidate detained on the mainland after police said they found him in bed with a prostitute in a Dongguan hotel, will not be disqualified from the Legco election. An Electoral Affairs Commission spokeswoman yesterday said the Department of Justice did not consider Mr Ho had been involved in a criminal offence. He was ordered to serve six months' re-education through labour but did not appear before a court. The department did not consider this a prison term, the spokeswoman said. Mr Ho is running in Kowloon East with Fred Li Wah-ming and Wu Chi-wai. Under Hong Kong's electoral laws, candidates are disqualified if they have been sentenced to more than three months imprisonment in the five years before polling day. The Democratic Party's election chief, Law Chi-kwong, said the party would largely drop Mr Ho from its campaign to avoid reminding voters of the incident.
