THE driver of a speedboat carrying two illegal immigrants, which allegedly rammed into a police rubber craft killing one officer and injuring another, yesterday was discharged by a High Court judge after it was discovered that the Governor's consent had not been obtained.

This follows a Court of Appeal decision last month stating that the Governor's consent was necessary for offences committed in Hong Kong waters.
However, Chan Heung-kui, 26, was re-arrested after he was discharged by Deputy Judge Yam. He is expected to appear in Eastern Court today after the relevant consent is obtained.
Chan was charged with the manslaughter of Sergeant But Yam-chiu. He was also charged with wounding Sergeant Cheung Wai-lun, who sustained brain damage.
