Attempt to uncouple joint trial

THE mother-in-law of former Carrian boss George Tan and three other women are appealing against a High Court decision to have a civil case against them heard jointly with former directors of Bumiputra Malaysia Finance Ltd (BMFL).

John McNamara - for Leong Lai Peng, former Carrian director Carrie Woo, and her two sisters, Cecilia Woo and Lily Leong - submitted that a great deal of the claims against the three directors of BMFL did not have anything to do with his clients.

The Court of Appeal reserved judgment on the application to overturn the consolidation of the two cases.

In March this year, Mr Justice Mortimer granted an application by the respondents, BBMB Finance (Hong Kong) Ltd (formerly known as BMFL) and its parent bank, Bank Bumiputra Malaysia, to consolidate the two civil actions.

The first action relates to events surrounding a US$40 million package advanced by BMFL as part of a rescue operation of Carrian.

Tan was the guarantor for the advance, which was never repaid. It was alleged the money was transferred to Switzerland and laundered through a number of private Swiss bank accounts in the names of Ms Leong and the three sisters.
