Q Should a tribunal be set up to resolve building-related disputes?
Yes. There are many problematic buildings in Hong Kong older than 30 years. Some of these are dangerous and require substantial repairs to maintain proper hygiene and safety. The government suggests owners' committees should be set up to take responsibility for the maintenance of their buildings. However, most property owners in these old buildings are senior citizens who have retired and do not have enough money to pay for the maintenance.
A tribunal is necessary to handle these cases. It will provide a channel where the elderly owners can at least state their difficulties and concerns. Various parties concerned, like government bureaus, the Housing Society and elderly owners, would be able to come up with solutions to address the issues.
As we know, most of these owners belong to what we call the 'asset-rich and cash-poor' sector, where most of their savings are tied up in their sole property, and there are no extra funds available to provide the long-needed maintenance. A comprehensive approach should be adopted by the tribunal to provide means for them to raise funds to carry out maintenance.
