Widow praises husband's courage but drops case

A lawsuit against Hong Kong Disneyland for offering substandard service has been thrown out because the claimant died two weeks ago.

Hung Wah-fung, 45,  lodged a claim in the Small Claims Tribunal on September 12, the day the theme park opened.

He claimed it had breached its service commitment during a visit with his family. He demanded his ticket costs and transport expenses, totalling $1,383.60, be reimbursed and donated to the Community Chest.

Hung's claim was struck out yesterday because he did not turn up for a scheduled hearing.

Last night his widow said Hung collapsed on October 25 and died in hospital the same day. The cause of death was still unknown.

Mrs Hung said she was not familiar with the law and would not continue the lawsuit, but she stressed that the family appreciated Hung's courage.

'We should speak out if there is injustice or else people will think you find things satisfactory,' she said.

Hung took his wife and two sons, aged 11 and 14, to Disneyland on September 4 when about 30,000 visitors packed the park for a charity day. He complained  that visitors had to spend up to four hours in the rain queuing for rides because of poor crowd management.

Slow restaurant service left  customers waiting about 30 minutes.

Hung said he was angry because the park had not offered any apology. But he said what prompted him to file the case was Financial Secretary Henry Tang Ying-yen's remarks that the charity day was a 'stress test for the theme park to see how staff and facilities would fare under its full capacity of 30,000 people'.

A spokesman for Disneyland said: 'It is our ongoing goal to ensure that our guests have a magical experience at Hong Kong Disneyland.'
