Any noise and nuisance committed by commencing renovation work before the deadline for quitting premises is seen as a breach of contract by the landlord.

The landlord should either delay the work until the premises are vacated or, if he cannot wait, waive the rent to compensate the tenants.

The tenants of Bo Yip building are lucky that their term of endurance of the nuisance is for six months and the landlord is ready to co-operate with them: Hanoi Road tenants of an old building locked in a construction zone outlined for development by the Town Planning Board have been frozen with their hardships for more than 25 years.
