The government is seeking legal advice from the Department of Justice on whether to prosecute a petrol station in Tuen Mun that overcharged customers.

Stephen Ip Shu-kwan, Secretary for Economic Development and Labour, said customs officers were collecting evidence about the case.

The pump at an Esso station in Tuen Yan Street overstated the amount of fuel dispensed by more than 5 per cent, overcharging by about HK$30 for 50 litres.

Responding to questions from lawmakers in the Legislative Council yesterday, Mr Ip, said such discrepancies were not serious.

'[In general], inspection records showed customers actually were given more fuel than they paid for. The discrepancy problem was in favour of consumers,' Mr Ip said.

Of the 300 pumps inspected by customs officers between January 9 and 19, 30 supplied less fuel than the displayed amount, with a discrepancy of less than 0.4 per cent. But 110 pumps supplied more fuel than the amount displayed, one by 3.5 per cent.
