Injured musician sues colleague

A FORMER concertmaster of the Hong Kong Philharmonic who sustained an eye injury after being punched by a fellow musician during a rehearsal has filed a writ with the Supreme Court claiming damages from his assailant.

Michael Ma Chung-wai, 47, contends that as a resulted of being assaulted by Siu Wai-tung he suffers permanent impairment of vision and has to engage another musician to help him read scores.

According to the statement of claim, Siu had been charged and convicted of an offence of assault occasioning actual bodily harm as a result of the incident.

The writ pleads that the incident occurred on December 28, 1992, when Ma was punched in the eye by Siu during a break at a rehearsal at the City Hall Concert Hall.

Ma claims he had to undergo an operation after the assault. As a result of the injuries he suffered permanent impairment of vision, including the inability to sustain upward or downward gaze.

Ma states that he continues to suffer pain in the right eye and needs follow-up treatment.
