Tyre recycler issues Eco Park writ

The government is facing a claim from a tyre recycler that has accused officials of 'misrepresentation' in documents about Tuen Mun's Eco Park, in which the operator was awarded a tenancy under an open tender process.

In a writ submitted to the High Court on Wednesday, Jets Technics Limited seeks a declaration from the court that it has 'validly rescinded' its tenancy agreement for a parcel of land at the park; otherwise the court should order that the agreement, made with the chief executive on behalf of the government on May 7 last year, be rescinded.

Jets Technics is also seeking the return of a bank guarantee issued by the Industrial and Commercial Bank of China in favour of the government.

Jets Technics never actually moved its factory, which is in Tai Po, to the Eco Park site.

The writ said the government had misrepresented information in several key documents and exchanges about Eco Park.

These documents included an environmental-impact assessment of Eco Park dated April 2005, an expression-of-interest document issued by the Environmental Protection Department on March 8, 2006, some legislature papers, meeting minutes and an e-mail.
