A bank manager accused of raping his domestic helper testified yesterday that the pair  were having consensual sex when they were interrupted by a phone call from his wife. 
'What did you do?' barrister Lawrence Lok  SC asked his client, Mak Lap-tak.  
The former Hang Seng Bank branch manager said he had stopped, 'left her, and turned to answer the phone. It was my wife. I was frightened'.
'How long did you talk?' Mr Lok asked.
'About one minute,' Mak replied, adding that after the call 'I continued to make love with her'. 
Mak, 50, told his trial in the Court of First Instance that he had not forced sex on the  woman, then 28.  She has accused Mak  of pushing her into the family's master bedroom before  forcing himself on her.
Mak pleaded not guilty to one count of rape. 
 He said yesterday that he and the helper chatted after his wife and two daughters  left the family's Wong Tai Sin flat on September 17. The conversation turned from talk about her sub-par cooking to their mutual feelings about missing sex, Mak said. 
The helper confided that she missed her husband in the Philippines, Mak said. She had arrived in Hong Kong for work about six weeks earlier. Mak told his employee that he and his wife rarely slept together,  and he then began to fondle the maid, the court heard. 
But  Mak insisted yesterday that he promised the woman he would pull back if she did not agree to sleep with him.  'Every move she made was to go along with mine, so I believe she had consented.'  
Afterwards, the maid took a shower and continued with housework, the court heard. She then called some fellow helpers to report that she had been raped, the trial has heard. Mak did not understand the conversation, but asked the woman if she was  all right, he testified.
'I asked her: 'Are you  OK?'' he said, adding: 'She said: 'OK.''
Under cross-examination, Mak denied  he tried to scare the woman into sex by asking  whether she had received a termination letter from his wife, who had earlier criticised the helper's work performance.
 'I had previously related to her [on that day] that we would not fire her,' he told senior public prosecutor David Chan.
The trial before Deputy High Court Judge Derek Pang Wai-cheong  continues today.
