Dentist ruling set for judicial review

A JUDICIAL review of the Hong Kong Dental Council's decision to allow a dentist convicted of sexually assaulting his patients to continue practising looks set to go ahead.

The Attorney-General's chambers had applied to the High Court for a judicial review of the case on behalf of council secretary Rupert Cheung Ming-bor, he said yesterday.

On April 21, the council decided Dr Daniel Yip Kar-leung, who was jailed in Canada for sexually and indecently assaulting his patients while they were under anaesthetic, could continue to practise in Hong Kong under certain conditions.

Mr Cheung works for the council but is not a party to its decisions. He is seeking a judicial review on the grounds that the council acted beyond its powers.

The council ruled that Dr Yip could continue to practise as long as a dental assistant was present during any contact with women patients and that he had regular psychiatric reports.

It also ordered that he must practise only with another dentist and not administer general anaesthetic.

But it is believed that under the Dentists Registration Ordinance, the council had no right to make its order subject to these conditions.
