Social worker Lee Sio-swat and the Director of Social Welfare, acting on the orphans' behalf, filed a writ in the Supreme Court alleging negligence by the driver, Mak Chi-hung.
They claim Mak was under the influence of drugs and alcohol when the accident happened.
According to the statement of claim, the orphans' mother, Wong Mei-chun, 35, a widow, was run over at the junction of Kwun Tong and Hong Ning roads on July 9, 1991, by a car driven by Mak.
It says Wong was using a pedestrian crossing controlled by traffic lights at the time.
