THE wife of an elderly casual worker, who remains in a coma seven months after falling from a moving van, has filed a writ with the Supreme Court claiming damages from the driver.
Lam Pui-king contends that the accident, in which her husband, Ho Tak, 66, sustained head injuries, was due to the negligence of Leung Bing-lun.
He is said to have moved the vehicle suddenly and without warning.
According to the statement of claim, Mr Ho was employed by Mr Leung as a casual worker.
On the morning of December 5 last year Mr Leung parked his van in a loading area at Cha Kwo Ling Road, Kowloon.
It is the plaintiff's case that when Mr Ho and his co-worker Yiu Leung-chu were loading sand in the rear compartment of the vehicle, Mr Leung, suddenly and without warning, drove the van forward.
As a result, it is pleaded, Mr Ho, who was standing, lost his balance and fell from the van on to the ground.
