A CONSTRUCTION worker jailed for raping his 10-year-old stepdaughter despite medical evidence that she was still a virgin had his name cleared yesterday.

Three Court of Appeal judges quashed four convictions for rape and indecent assault after strongly criticising the High Court judge who presided over the original trial.

They said Mr Justice Wong should have halted the case after a doctor's report showed the girl could not have been raped because her hymen was intact.

The man was jailed in November last year after his younger stepdaughter, now 13, claimed he had raped her and twice molested her when she was about 10 years old.

The girl's sister, now 15, also had accused the man of indecently assaulting her when she was 12.

During the trial, a doctor who examined the younger girl said she was a virgin.

Despite the medical evidence, the jury still convicted the 39-year-old man of one count of rape and three counts of indecent assault between January 1989 and December 1991.
