A GAME designer is claiming $122 million in damages from a company that not only failed to manufacture his 'Galaxion' board game as agreed, but pinched the name to form a new company, the Court of Appeal heard yesterday.

Elijah Saatori told the court he had designed Galaxion in 1982 and had come to Hong Kong with a bank loan from Britain to have the game manufactured.

He agreed terms with Pioneer Advertising Limited and its managing director, Peter Cheng, but the game was not produced after a dispute over the price.

Mr Saatori left Hong Kong in 1984 but returned in 1989 and found that Mr Cheng had formed a company called Galaxion Amusement Production Limited.

In June 1989, the parties signed a settlement. However, Mr Saatori claimed he had signed the agreement under duress.

Two months later, Mr Saatori and his company, Cerebe Design Limited, launched legal action claiming damages for fraudulent misrepresentation, breach of contract, refusing to return the artwork and breach of copyright for the name Galaxion.
