A 26-year-old man who attempted to rape a 62-year-old woman when he was drunk was jailed for six years in the High Court today.

Chu Kwun-chung  pleaded guilty to one count of attempted rape against the victim at an open car park at Ma Wat Wai, Fanling in the early morning of September 21 last year.

He told the police he was sexually excited and could not control himself after he and friends consumed two dozen cans of beer the night before. He said he had no idea how old the victim was.

Madam Justice Judianna Barnes Wai-ling  said she found the 62-year-old could be regarded as old, but added “[the victim] would not expect to be raped while she was on the way to work. She should go to her business without fear of being sexually assaulted.”

She found the case had “too many aggravating factors” as Chu had used violence on the victim and did not use a condom.

The judge said if Chu had actually raped the victim, he would have been sentenced to 1061/27 years in jail. However, she reduced it as Chu faced an attempted rape charge and had admitted the charge.
