A man from the city of Kamloops in British Columbia, Canada is suing Gateway Casinos & Entertainment Ltd. and pub operator Commodore Ventures Ltd., claiming he was over-served alcohol by casino staff before he crashed his car and suffered a spinal cord injury that left him a quadriplegic.
William James McCreight filed a notice of civil claim in BC Supreme Court on June 8. McCreight alleges that he was “showing obvious signs of impairment” when defendants’ employees at the Match Public House and Eatery served him alcohol on January 25, 2016. He claims the defendants “knew or ought to have known that it was likely that the plaintiff would drive away” from the pub and casino and “because of his impaired condition, he would be at risk to himself and to other people using the highways,” his claim states.
Early in the morning of January 26, 2016, McCreight claims he left the casino and pub and drove to the Commodore Grand Cafe & Lounge,where he consumed more alcohol. Within minutes of leaving the lounge, he was involved in a single-vehicle accident, suffering several injuries.
McCreight claims he was illegally over-served alcohol in contravention of the province's Liquor Control and Licensing Act.
The defendants include Gateway Casinos & Entertainment Ltd. dba Cascades Casino, Gateway Casinos & Entertainment Ltd. dba Match Public House and Eatery, Commodore Ventures Ltd. dba the Commodore Grand Cafe & Lounge, and four John Doe employees.
He seeks general and special damages and costs under the Health Care Costs Recovery Act.
