Judge finds Filipino, 45, guilty of three counts of indecent assault and dismisses her evidence as ‘a travesty of the true nature of events’

A domestic helper who had sex with an eight-year-old boy was found guilty on Monday of three counts of indecent assault.

The 45-year-old Filipino woman, who told the District Court she was a lesbian, will be sentenced next month pending submission of an impact report on the victim and a psychologist’s report on the helper.

The court heard that she molested the boy and engaged in penetrative sex with him in a Kwai Chung flat three times between 2011 and 2013.

Judge Johnny Chan Jong-herng also accepted the boys claims in a recorded video interview of “numerous” uncharged indecent assaults as “true and reliable”.

“In my judgement, the sexual orientation of the defendant does not preclude her from committing the three offences and the uncharged acts in question,” Chan said in his verdict.

The helper, who lived with the boy’s family between 2007 and 2013, had previously told the court that she was not attracted to men and had had two lengthy same-sex relationships since she came to Hong Kong in 2001.

She pleaded not guilty to the charges and described the boy as a “freak sometimes” with “wild flights of imagination”.

Chan dismissed the accusations as “a travesty of the true nature of events”.

The boy testified that he did not tell his parents about the assaults until July last year, when he was 13 years old and had received education on animal reproduction. He told his mother that he had “committed a crime” before revealing the assaults.

The boy said he did not make the complaint earlier because he was afraid that the helper would leave his family and he did not know how to tell his parents.

Chan found the boy “an honest and reliable witness”. He also saw no reason why he would make up allegations against the helper since she had maintained a good relationship with the family, and the boy’s mother even invited her to a party in 2014 to celebrate Christmas and the helper’s birthday.

The court heard earlier that the first charged incident happened in 2011 after the woman “threw a temper for no apparent reason”, started to pack up her things and told the boy that she would no longer look after him.

After the boy urged her not to leave, she took him into her room, took off his pants, molested him and had sex with him.

The second incident happened one week later with the helper using the same method to get the boy into having sex with her.

The third incident happened in 2013 in the toilet of the flat, where the helper made the boy sit on the toilet seat, molested him and had sex with him.
